TERMS AND CONDITIONS for bookings and purchases 1. Interpretation.
In these Terms and Conditions ( Terms ), the following words and phrases
shall have the following meanings: 2. The Contract. The Contract shall be on these Terms to the exclusion of all other terms and conditions, including any such terms and conditions that are purported to be included or applied by the Buyer. No terms and conditions contained in the confirmation of order, purchase order or other document of the Buyer will form part of the Contract. 3. Delivery of Goods. Any dates specified by the Company for delivery of the Goods are intended to be an estimate only. If no date is specified for delivery of the Goods, delivery shall be within a reasonable time. Subject to the other provisions of these Terms, the Company shall not be liable for any loss, whether direct or consequential, economic or loss of profits or otherwise, arising directly or indirectly out of any delay in the delivery of the Goods nor will any delay entitle the Buyer to terminate or rescind the Contract unless the delay exceeds 60 days. 4 Payment. Although we have secure*on-line credit card payment facilities, you can submit your order on-line and pay by cheque, if you prefer. Refunds for goods purchased by credit card will be given at the discretion of the Company Management. All Villa holiday deposits must be made by cheque. 5.Villa Rental Contracts. In order to make a booking, the buyer must submit an on-line booking enquiry form. In making the enquiry and in making a subsequent booking, the buyer guarantees that he or she has the authority to accept and does accept on behalf of the party the terms of these booking conditions. A contract will exist as soon as we issue our confirmation details. If you have any special request you must advise us at the time of booking. Although we endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of contract on our part. We regret we cannot accept any conditional bookings, for example any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as standard bookings subject to the above provisions on special requests. 6. The Rental Price. When you confirm your booking we ask you to pay a deposit of up to £100 per week which we hold on behalf of the villa management company concerned. Dependent on your choice of resort the balance of the price must either be paid on arrival at the resort or at least ten weeks before your departure date and if the balance is not paid in time, we are entitled to treat your booking as cancelled by you and retain your deposit. Where relevant the price of your rental or rental deposit is calculated using exchange rates quoted in UK newspaper Guides to World Currencies or similar. 7. Changes to the Rental Booking. If after our confirmation has been issued, you wish to change your rental arrangements or dates we will, at our discretion, do our best to make these changes but it may not always be possible. Any request for changes must be from the person who made the booking. 8. Cancellation of the Rental Booking If you cancel your booking it must be made in writing by the person who made the booking. We will accept notification by letter or fax, which will be effective from the date received by us. Since we incur costs in cancelling your travel arrangements, you will have to pay the applicable cancellation charges equal to your deposit sum paid. Please note that if the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these cancellation charges from your insurance company less any applicable excess. 9. If We Change Your Booking. It is unlikely that we will have to make any changes to your rental arrangements but as all the accommodation is privately owned if something unforeseen happens we reserve the right to offer you alternative accommodation. Most of these changes will be minor and we will advise you of them at the earliest possible date. No compensation is payable for minor changes. 10. Force Majeure. Unless otherwise expressly stated in these booking conditions, we are unable to accept liability or pay compensation where the performance, or prompt performance, of the contract is prevented or affected by 'force majeure'. Within these conditions, 'force majeure' means any event which we or our suppliers could not, even with all due care, avoid or foresee. Such events include but are not limited to war, fire, riot, industrial disputes, closure of airports and ports, technical problems with transport, terrorist activity, natural or nuclear disaster, fire, unforeseen building or road works, adverse weather conditions and other events beyond our control. 11. If You Have a Rental Problem. If you have a problem during your rental, please inform the resort management team immediately who will endeavour to put things right on the spot. You have chosen to make your own transport arrangements. We cannot accept liability for any transport delay or any costs incurred by you as a result of such delay. However you may be able to claim for lengthy delays through your insurance policy if you have this cover. 12. Holiday Insurance and Travel Documents. It is an absolute requirement of booking that each and every person staying in one of the rental properties is covered by adequate travel insurance. The properties are all privately owned and it is your responsibility to ensure you have insurance which is adequate and appropriate for your particular needs. Please read your policy before departure and take it on holiday with you. The rental contract is governed by Spanish Law and the parties agree to submit to the exclusive jurisdiction of the Spanish Courts at all times. 13 Car hire and other agency bookings such as flights. The Company act as intermediate agents and your contract will be with the third party concerned. |
